These Terms of Service (“Terms”) are a binding agreement between you and Bento Ventures, a Sole Proprietorship based in Mysuru, Karnataka, India (“Bento”, “we”, “us”). They govern your use of the Bento mobile app, the website at createbento.in, and every related service (the “Service”). By creating an account or using the Service you accept these Terms and our Privacy Policy, Refund & Cancellation Policy, Delivery & Fulfilment Policy and Community Guidelines, which form part of them.
These Terms are an electronic record under the Information Technology Act, 2000 and do not require a physical signature.
1. What Bento is
Bento is a platform where you discover restaurants through short-form content, act on offers those restaurants make, visit them, and earn rewards for verified visits. Bento is a marketplace and intermediary: the food, the table and the perk are supplied by the restaurant, and the content is created by users. Bento does not cook, serve or deliver food and is not a party to the sale of food between you and a restaurant, except where these Terms say otherwise.
2. Eligibility and your account
- You must be at least 18 years old and capable of entering a binding contract under Indian law.
- One account per person, registered to a mobile number you control. You are responsible for everything done through your account. Keep your device secure and tell us at once if you suspect misuse.
- Give us accurate information and keep it current. We may suspend an account that uses a false identity.
- We may refuse, suspend or close an account for breach of these Terms, suspected fraud, or where the law requires. You may close your account at any time; see Account deletion.
3. Perks, offers and how they lock
- Restaurants publish perks (for example a free dessert above a minimum spend, a percentage off, a bundle) and control their eligibility, minimum spend, timing, party size, inventory and validity. A perk shown in the feed is live and may change or end at any time before you act on it.
- When you claim a perk, buy a Dine Pass, or confirm a booking, the exact terms shown to you at that moment are recorded and frozen for that transaction (the “snapshot”). Later changes to the live offer do not affect your snapshot, and the expiry of a live offer does not cancel a valid snapshot.
- Each snapshot states its own validity window, minimum spend and other conditions. It is honoured only within those conditions, once, by the person who holds it, at the named restaurant.
- Perks are not cash, cannot be exchanged for cash, and cannot be combined with other offers unless the snapshot says so.
- Inventory is finite. A claim succeeds only if stock remains at the moment you tap; the app confirms success or tells you it is gone.
4. Dine Passes
- A Dine Pass is a prepaid commitment, typically ₹49 to ₹199, that carries a perk and is adjusted in full against your eligible bill at the restaurant during its validity window. It is not a gift card, a stored-value instrument or a deposit with Bento, and it has no cash value outside its terms.
- The pass amount, the perk, the minimum spend, the validity window and the cancellation terms are shown before you pay and frozen after.
- Bento collects the pass amount on behalf of the restaurant. The restaurant is the supplier of the meal and the perk.
- Refunds and cancellations follow the Refund & Cancellation Policy and the terms on your pass.
5. Table bookings
- A booking is a request to the restaurant that becomes confirmed when the app shows it as confirmed. Some bookings require a deposit, shown before you confirm and adjusted against your bill when you arrive.
- Arrive within the grace window shown on the booking. If you do not arrive and did not cancel within the cancellation window, the booking is marked a no-show and any deposit is forfeited to the restaurant.
- If the restaurant cancels, any deposit is refunded in full.
- Group bookings: the person who creates the plan is responsible for the booking. Invitees who join accept these Terms.
6. Payments
- Payments are processed by Cashfree Payments India Pvt. Ltd. By paying you also accept Cashfree's terms. Bento does not store your card number, UPI PIN or bank credentials.
- All prices are in Indian Rupees and include GST where applicable. The amount you see before you confirm is the amount you pay; Bento adds no service or convenience fee.
- If money is debited but the app does not show a successful pass or booking, do not retry more than once; the payment will either be matched to your order or automatically refunded within 5 to 7 business days. Contact support@createbento.in if it is not.
- You authorise us to charge the payment method you choose for the amounts you confirm.
7. Check-in and bill verification
- To redeem a perk or pass you check in at the restaurant, usually by scanning the table QR code, and staff verify your bill. Verification confirms the visit, the eligible spend and the perk.
- Restaurant staff may decline a redemption that does not meet the snapshot terms (for example below minimum spend or outside the window). Disputes go to support@createbento.in within 7 days of the visit with your booking or pass reference.
- You agree not to falsify a check-in, a location, a bill or a QR scan. Doing so forfeits the related rewards and may close your account.
8. Rewards
- Rewards are earned for verified outcomes: a verified visit, a verified referral, or content that leads to verified visits. Rewards are pending until verification completes and may be reversed if the underlying transaction is refunded, disputed or found fraudulent.
- Diner rewards are normally restaurant-specific credit or perks. They are not cash, not transferable, and expire as stated when issued. Bento does not operate a general-purpose wallet.
- Bento never pays for reviews or ratings, positive or otherwise. Any attempt to sell or solicit a review is a breach of these Terms.
- We may change reward programmes prospectively. Rewards already released are not affected.
9. Creators
- Anyone may post content and refer friends. Pro and Elite status is granted by Bento on criteria including verified local conversions, content quality and reliability, and may be withdrawn for breach of these Terms.
- Paid restaurant campaigns are offered through the app with their fee, deliverables and performance terms stated up front. Accepting a campaign is a contract to deliver what it says. Campaign content must be labelled as sponsored.
- Payouts are made only after the qualifying visits are verified, to a bank account or UPI ID in your own name, less any tax we must deduct. You are responsible for your own taxes on payouts and for holding any registration (such as GST) the law requires of you.
- Attribution is decided by Bento's records at the qualifying commercial event and is final except in the case of demonstrable error.
10. Your content
- You own what you post. You grant Bento a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt (for example transcode, crop and caption), display and distribute your content within the Service and in Bento's own promotion of the Service, for as long as the content remains on Bento, and thereafter only in aggregate analytics and as required by law.
- You confirm that you have the rights to everything you post, including music, and that it does not infringe anyone's rights or break the law or our Community Guidelines.
- Bento may remove content, restrict its distribution, or label it, at our discretion and without notice, including for moderation, legal compliance or quality. Appearing in the Discover feed is never guaranteed.
- Bento is an intermediary under Section 79 of the Information Technology Act, 2000 for content posted by users. We do not pre-approve user content. Report content that concerns you through the in-app report button or to our Grievance Officer.
11. Acceptable use
You agree not to: create multiple or fake accounts; use another person's identity or payment method; falsify location, check-ins or bills; buy, sell or solicit reviews, follows or engagement; scrape, reverse-engineer or interfere with the Service; circumvent inventory, eligibility or reward rules; post content that is unlawful, defamatory, obscene, harassing, hateful, misleading, infringing or that endangers anyone; or use the Service for any purpose other than what it is for. Restaurant and staff accounts must not be used to redeem perks for themselves or to manipulate verification.
12. Restaurant partners
Restaurants join Bento under a separate Partner Agreement that sets fees, settlement and campaign terms. These Terms apply to restaurants in addition to it. Restaurants are solely responsible for the food and service they provide, for their menu, pricing, hygiene, licences and compliance with the Food Safety and Standards Act, 2006, for honouring every snapshot they issued, and for the accuracy of what they publish on Bento.
13. Bento's intellectual property
The Service, its software, design, trademarks and content created by Bento belong to Bento or its licensors. We grant you a limited, revocable, non-transferable licence to use the app on a device you control, for personal use, under these Terms. Do not copy, modify, distribute or create derivative works of the Service.
14. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Bento disclaims all warranties, express or implied, including fitness for a particular purpose. Bento does not guarantee that a restaurant will be open, that a dish will be available, that content is accurate, or that the Service will be uninterrupted or error-free. Food allergens, hygiene and dietary information are the restaurant's responsibility; confirm them with the restaurant.
15. Limitation of liability
To the fullest extent permitted by law, Bento is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Service. Bento's total liability to you for all claims in any twelve-month period is limited to the greater of ₹1,000 and the amounts you paid to Bento (not to restaurants through Bento) in that period. Nothing in these Terms limits liability that cannot be limited under Indian law, including under the Consumer Protection Act, 2019.
16. Indemnity
You will indemnify Bento against claims, losses and costs (including reasonable legal fees) arising from your content, your breach of these Terms, or your violation of any law or third-party right.
17. Suspension and termination
We may suspend or terminate your access for breach of these Terms, suspected fraud, legal requirement, or extended inactivity, with notice where practicable. On termination, unreleased rewards tied to fraud are forfeited; valid pending refunds are still paid; sections that by their nature should survive (including 10, 13 to 19) survive.
18. Grievance redressal
Our Grievance Officer, appointed under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020, is The Proprietor, Bento Ventures, reachable at grievance@createbento.in or by phone at +91 89048 48440. Complaints are acknowledged within 24 hours and resolved within 15 days. Consumer disputes may also be taken to the consumer commissions established under the Consumer Protection Act, 2019, or the National Consumer Helpline.
19. Governing law and disputes
These Terms are governed by the laws of India. Subject to the grievance process above and to any non-excludable consumer rights, the courts at Mysuru, Karnataka have exclusive jurisdiction over disputes arising from these Terms or the Service.
20. Changes to these Terms
We may update these Terms. We will post the new version here with a new effective date and, for material changes, notify you in the app at least 7 days before they take effect. Continued use after that date is acceptance. Snapshots created before a change are governed by the terms in force when they were created.
